ARTICLE 2 – SUBJECT

The subject of this Agreement is to determine the rights and obligations of the parties regarding the sale and delivery of original and/or editioned works of art ordered electronically by the BUYER through the SELLER’s website.

This website is not a gallery, a mass-production store, or a commercial intermediary platform. All works presented on the website are part of an independent artistic practice and shall not be considered conventional retail products.

ARTICLE 3 – WORKS, PAYMENT, AND DELIVERY

3.1. WORKS

All editioned photographs offered on the website are produced in limited numbers and are delivered with a certificate of authenticity.

Each edition is limited to the specified dimensions, printing technique, and edition number. The same work shall not be reproduced again using the same size and technique.
Original works are unique and one of a kind.

Prices displayed on the website are for informational purposes only and edition prices may be updated over time.

3.2. PAYMENT

Payment is made in advance via the payment methods provided on the website.
The purchase covers only the ownership of the physical artwork.

3.3. DELIVERY

Some works are produced upon order. Printing, preparation, and delivery times vary depending on the type of work, printing technique, and production process, and are generally shipped within 7–9 business days.

The stated timeframes are estimates and may vary due to the nature of artistic production.

Shipping and delivery times are beyond the direct control of the SELLER and may vary depending on the BUYER’s country and region.
All customs duties, taxes, and import-related costs are the responsibility of the BUYER.

ARTICLE 4 – INTELLECTUAL PROPERTY AND USAGE RIGHTS

The purchase does not include the transfer of copyright, reproduction, distribution, or commercial usage rights of the artwork.

All such rights remain with the SELLER.
Without the SELLER’s written permission, artworks may not be copied, reproduced, reprinted, or used for commercial purposes.

In cases of sharing or exhibition, attribution to the artist is mandatory.

ARTICLE 5 – COLOR, TONE, AND APPEARANCE DIFFERENCES

Differences in color, contrast, and tone may occur between digital displays and physical prints.
Screen calibration, lighting conditions, printing techniques, and materials may cause such differences.

These differences are not considered defects and do not constitute grounds for return.

ARTICLE 6 – RETURNS AND EXCHANGES

Due to the nature of artworks and editioned prints, returns or exchanges are not accepted.
All sales are final.

In cases of physical damage during shipping or incorrect delivery, the situation may be reviewed if the BUYER contacts the SELLER within a reasonable time after delivery.

Personal preference, color perception, or subjective expectations are not accepted as reasons for return.

ARTICLE 7 – LIMITATION OF LIABILITY

The SELLER shall not be held responsible for delays or disruptions caused by the shipping carrier.
If damage is detected upon delivery, the BUYER is responsible for having an official damage report prepared at the time of delivery.

ARTICLE 8 – GOVERNING LAW AND JURISDICTION

This Agreement shall be governed by the laws of the Republic of Türkiye.
Istanbul Central Courts and Enforcement Offices shall have exclusive jurisdiction over any disputes arising from this Agreement.

This Agreement is deemed to have been read, understood, and accepted electronically by the BUYER upon completion of the order.
